Right of withdrawal

1. Overview — when you have a right of withdrawal
If you are a consumer, you have a statutory right of withdrawal for contracts concluded at a distance. At ZoFound there are two separate routes, because there are two different sellers:

Using ZoFound itself — your account, your profile and the free features — costs nothing; you can delete your account at any time (Terms, clause 10) without needing to withdraw from anything.
2. Purchases via the App Store or Google Play
2.1 If you buy a subscription or a Love-Pass in the ZoFound app, the payment contract is concluded with Apple Distribution International Ltd. or Google Commerce Ltd. Those companies are your contracting party for that purchase and owe you the withdrawal notice for it.
2.2 Where to withdraw or request a refund:
- Apple:
reportaproblem.apple.com— sign in with your Apple ID, select the purchase and report a problem. Alternatively via the receipt in your email or via Apple Support. - Google:
play.google.com/store/account/orderhistory— select the order and request a refund; alternatively via Google Play Support.
2.3 Cancelling is not the same as withdrawing. Cancellation ends a subscription at the end of the current billing period (Terms, clause 8.5). Withdrawal is directed at the conclusion of the contract itself.
2.4 If you get stuck with Apple or Google, write to support@zofound.com. We cannot refund the purchase ourselves, but we will help with evidence about your account and, where possible, approach the provider concerned.
3. Purchases directly from us
Clauses 4 to 8 apply to contracts you conclude directly with LOVY — currently gift cards for ZoFound features offered through our website.

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
4. Withdrawal period
The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
5. Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested that the performance of services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
6. When the right of withdrawal lapses early
6.1 Digital content (for example a gift card code delivered immediately). Your right of withdrawal lapses early if we have begun performance after you have
- expressly consented to us beginning performance before the end of the withdrawal period,
- acknowledged that you thereby lose your right of withdrawal once performance begins, and
- we have provided you with a confirmation of the contract on a durable medium.
We obtain both statements in the ordering process using two separate, non-pre-ticked boxes, and send you the contract confirmation by email immediately after purchase. If you do not tick them, we provide the gift card code only after the withdrawal period has expired.
6.2 Services. For contracts for the supply of services, your right of withdrawal lapses once the service has been fully performed, provided that before performance began you expressly consented and acknowledged that you would lose your right of withdrawal upon full performance.

6.3 Nor is there a right of withdrawal for contracts for services connected with leisure activities where the contract provides for a specific date of performance (§ 312g(2) no. 9 BGB).

7. What withdrawal does not affect
7.1 Withdrawal concerns the individual purchase, not your ZoFound account. Your account continues until you delete it yourself (Terms, clause 10).
7.2 Your statutory rights where the service is defective (Terms, clause 11) exist alongside the right of withdrawal and are not limited by it.
