These Terms of Use (“Terms”) are a binding agreement between you and (“ZoFound”, “we”, “us”), governing your access to and use of the ZoFound mobile app and related websites and services (together, the “Service”). By creating an account or using the Service you accept these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.
This document also serves as the End User License Agreement (EULA) for the app.
1. Who can use ZoFound (eligibility)
- You must be at least 18 years old. ZoFound is an adults-only dating and friendship service. We may remove accounts we reasonably believe belong to minors.
- You must have the legal capacity to enter a contract and must not be barred from using the Service under any applicable law (including sanctions/export laws).
- You must not have been previously removed or banned from the Service.
- One account per person. Accounts are personal and non-transferable.
2. The Service — what ZoFound does
ZoFound helps people meet online first and create real connections (romantic and/or platonic). The Service includes, depending on your plan and settings:
- Profiles & matching — you create a profile; we surface other users (including people nearby) and suggest matches using interests, intent (romance/friendship), and proximity. A “mystique reveal” gradually reveals a match as a conversation deepens.
- 1:1 messaging & calls — text chat and, where enabled, voice and video calls. Calls are never “cold”: a call is only offered once the relationship has reached the required engagement, and the person you call is given a warm heads-up and must accept before connecting.
- Zoe — our AI host — an AI assistant that helps you plan dates, coaches you, suggests how to open a conversation, proposes meeting places, and (with your consent) reads recent chat messages only in the moment, without storing them, to give better suggestions. Zoe is software, not a person, and her suggestions are not professional advice. See §6.
- ZoDate (plan a date) — Zoe mediates agreeing a date (physical or online; for online dates the format — video or voice — and a concrete time) between two users, then both are rung at the agreed time.
- Speed Dating — scheduled group events with short timed conversations.
- Verification — an optional “ZoFound Verified” status; some contact features require both parties to be verified.
We may add, change, or remove features. We will update these Terms and notify you of material changes (see §13).
3. Your account & security
- Provide accurate information and keep it up to date. You are responsible for activity under your account.
- Keep your login credentials secure. Tell us promptly of any unauthorised use.
- We use sign-in providers and security tooling (e.g. Firebase Authentication, App Check). Abuse of these protections is prohibited.
4. Subscriptions, purchases & cancellation
- ZoFound offers free features and paid plans (e.g. Match-Klar — a one-time purchase, and Match-Komplet — a subscription). Exact names, prices, and entitlements are shown in the app and in the relevant app store at the time of purchase.
- Purchases are processed by Apple App Store / Google Play under their terms; we do not receive your card details. Subscriptions auto-renew until cancelled in your app-store account.
- Right of withdrawal (EU): digital content/services begin immediately on purchase with your consent; statutory withdrawal rights and any store refund policies apply. Manage or cancel subscriptions in your App Store / Google Play account.
- Quotas and entitlements (events, matches, AI-coach minutes) are described in the app and may be adjusted via configuration; we will not reduce a paid entitlement you have already purchased without a fair remedy.
5. Your content & licence
- You retain ownership of the photos, video, audio, text, and other content you submit (“Your Content”).
- You grant ZoFound a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, display, and adapt Your Content solely to operate, secure, and improve the Service (e.g. show your profile to matches, deliver your messages/calls, generate a “mystique summary”). This licence ends when the content or your account is deleted, except for backups and where retention is legally required.
- You are responsible for Your Content and must have the rights to share it. Don’t post anything you don’t have permission to share.
6. The AI host (“Zoe”) — important terms
- Zoe is an automated assistant built on third-party AI models (currently Google Vertex AI Gemini, and Tavus/Daily for the coach avatar). Zoe is not a human, not a licensed counsellor, and her output may be wrong — use your own judgement.
- Chat-history reading is consent-based and on-demand. If you grant the “Zoe may read chat” permission (at onboarding, in your policy acceptance), Zoe may read recent messages in a conversation only at the moment she needs them, only to choose how best to help (e.g. judge whether you both want to talk, draft a message, suggest a venue). She does not store the messages she reads, and we send them for processing only with that consent. Reading a conversation’s content also requires the other participant’s equivalent consent. You can withdraw this permission (see Privacy Policy).
- No cold contact via AI. Zoe will not let you place a voice/video call to someone you have not sufficiently engaged with; instead she helps you open a conversation first.
- You must not try to manipulate Zoe to break these Terms, extract another user’s private data, or generate prohibited content.
7. Acceptable use & safety
You agree to follow our Acceptable Use Policy. In short: be respectful, be honest, no harassment, no illegal, hateful, sexual-exploitation, or deceptive content, no spam, no scraping, no off-platform solicitation for payment. We provide tools to report and block users, and we may remove content and suspend or terminate accounts that violate these Terms (see §10). Meeting people carries real-world risk — you are responsible for your own safety; never send money to people you meet, and meet new people in public.
8. Privacy & data
Your use of the Service is also governed by our Privacy Policy, which explains what we process, why, the legal basis, our sub-processors (e.g. Google Firebase/Vertex AI, Agora, Adapty, OneSignal), international transfers, retention, and your GDPR rights. By using the Service you acknowledge that Privacy Policy.
9. Intellectual property
The Service, including its software, design, brand, and content we provide (but excluding Your Content), is owned by ZoFound or its licensors and protected by IP laws. We grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, reverse-engineer (except as permitted by law), resell, or build a competing service from the Service.
10. Suspension & termination
- You may stop using the Service and delete your account at any time (Settings → Account). Deletion removes your personal data subject to the retention rules in the Privacy Policy and any legal holds.
- We may suspend or terminate your access, with or without notice, if you breach these Terms or the Acceptable Use Policy, create risk or legal exposure, or as required by law. We aim to act proportionately and, where appropriate, give you a chance to respond.
- Sections that by their nature should survive termination (e.g. §5 licence tail, §9, §11, §12, §14) survive.
11. Disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties (e.g. merchantability, fitness for a particular purpose, non-infringement) and do not warrant that you will find a match, that the Service will be uninterrupted or error-free, or that AI output is accurate. Mandatory consumer rights are unaffected.
12. Liability
To the extent permitted by law, ZoFound is not liable for indirect, incidental, special, or consequential damages, or for the conduct of other users or third parties. Nothing in these Terms limits liability that cannot be limited by law (e.g. for death or personal injury caused by negligence, fraud, or your statutory consumer rights). Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim, to the extent permitted by applicable law.
13. Changes to these Terms
We may update these Terms. For material changes we will give reasonable notice (in-app
and/or by the contact you provided) and, where required, ask you to re-accept before
continuing to use the Service. The current version, its version number, and
effective_date are shown at the top of this document.
14. Governing law & disputes
These Terms are governed by the laws of Denmark, without prejudice to mandatory consumer protections in your country of residence. Disputes are subject to the competent Danish courts, again without prejudice to mandatory consumer venue rules. EU consumers may also use the EU Online Dispute Resolution platform. to follow
